Licensing jurisdictions and cross-border user access

NexPlace operates under formal regulatory registrations in specific jurisdictions, while providing limited, self-directed access to eligible users from other countries, subject to applicable restrictions.

Jurisdictions where NexPlace is licensed

NexPlace currently holds regulatory registrations in the following jurisdictions:

El Salvador, where NexPlace is registered as a Digital Asset Service Provider under the Digital Asset Law and supervised by the National Commission of Digital Assets (CNAD). The scope of the licences includes the following activities:

  • Exchange of digital assets for fiduciary money or equivalent or for other digital assets, either using their own capital or that of a third party
  • Operate a platform for the exchange or commercialization of digital assets or digital asset derivatives.
  • Evaluation of risk and price, as well as subscription to digital asset issuances;
  • Place digital assets on digital platforms or wallets.
  • Promote, structure, and manage all types of investment products in digital assets.
  • The following operations when carried out on behalf of and for the benefit of third parties:
    • Transfer digital assets or the means to access or control them, between individuals or legal persons or between different acquirers, electronic wallets, or accounts of digital assets;
    • Safeguard, custody or manage digital assets or the means to access or control them;
    • Receive and transmit orders to buy or sell digital assets or negotiate derivative digital assets;
    • Execute orders to buy or sell derivative digital assets

Argentina, where NexPlace is registered as a Virtual Asset Service Provider with the National Securities Commission (CNV). The scope of the licences includes the following activities: 

  • Exchange between Virtual Assets and legal tender (fiat currencies).
  • Exchange between one or more forms of Virtual Assets.
  • Transfer of Virtual Assets.
  • Custody and/or administration of Virtual Assets or instruments that enable control over them (provided they are not non-custodial).

In these jurisdictions, NexPlace operates as a locally regulated marketplace, subject to:

  • Local regulatory oversight, reporting, and audit obligations,
  • Locally applicable compliance and governance requirements, including (as applicable) AML/CFT, data protection and privacy, cybersecurity and information security controls, anti-bribery and anti-corruption, and consumer protection obligations,
  • A Locally scoped service model, meaning the availability of specific services—such as trading features, custody-related controls, and any fiat on/off-ramps—is determined by local law and regulatory approvals.

Access from other jurisdictions (cross-border, self-directed model)

Outside its licensing jurisdictions, NexPlace may allow access to certain users on a cross-border, self-directed basis, where permitted by applicable local law and NexPlace’s internal compliance and risk policies.

In these cases:

  • No local licensing/registration: NexPlace is not licensed or registered in the user’s home jurisdiction unless expressly stated,
  • Execution-only: Services are provided on an execution-only, non-advisory basis. NexPlace does not provide investment advice, portfolio management, or recommendations,
  • Jurisdiction-based restrictions: Certain assets, offerings, features, or payment methods (including fiat rails) may be restricted or unavailable depending on the user’s location, profile, and eligibility.,
  • No local targeting: NexPlace does not conduct local marketing or solicitation in jurisdictions where it is not authorized, and does not represent that its services are offered under local regulatory approval.

Who is not eligible

The following users are not eligible to access NexPlace:

  •  U.S. Citizens, as defined in the applicable NexPlace terms and relevant regulations, individuals or entities included in the United Nations Security Council Sanction list.
  • Residents of jurisdictions on NexPlace’s restricted list. We are set to have clients in countries that are out of our prohibited jurisdiction list, so that means that we´re not going to operate in: Cuba, Democratic People’s Republic of Korea (North Korea), Iran, Syria, Myanmar, Crimea (a region of Ukraine annexed by the Russian Federation), the self-proclaimed Donetsk People’s Republic (a region of Ukraine), the self-proclaimed Luhansk People’s Republic (a region of Ukraine), the self-proclaimed Kherson People's Republic (a region of Ukraine) and the self-proclaimed Zaporizhzhia People's Republic (a region of Ukraine); and FATF High Risk Jurisdictions subject to a call for action; Iraq, Armenia, Azerbaijan, Belarus, Cambodia, Kyrgyzstan, Laos, Mongolia, Nigeria, Tajikistan, Turkmenistan, United States of America, Uzbekistan, Vietnam.

How eligibility and access are determined

Eligibility to use NexPlace—and the specific products and features available to you—is determined through our onboarding process and ongoing compliance controls, including:

  • Compliance, risk, and jurisdictional checks, including screening and eligibility assessments required by law and our internal policies, and
  • The information you provide during onboarding, together with KYC/KYB verification (as applicable).

 If your onboarding is completed successfully, NexPlace will enable only those products and services that are permitted based on your jurisdiction, user type, and risk profile. Some assets, offerings, payment methods, or features may therefore be available in certain countries and not others.

Please note that our licensing status, restricted jurisdictions list, and product availability may change over time due to regulatory, legal, or policy updates.

Important notes

  • Access does not equal licensing. Being able to use NexPlace from a country does not mean NexPlace is licensed or regulated in that country.
  • Different regulatory scope. Services provided in our licensed jurisdictions are offered within a local regulatory perimeter. Where access is provided cross-border, the service is offered on a more limited, self-directed (execution-only) basis, subject to applicable law and NexPlace policies.
  • Product availability may vary. Even if basic platform access is available, certain products, offerings, payment methods (including fiat rails), or features may be available only in licensed jurisdictions or only to eligible users.
